Entrepreneur and producer Raj Kundra was finally granted bail by a Mumbai court today. Kundra had moved the metropolitan magistrate's court at the Esplanade for bail on the grounds that the investigation against him had been completed.
According to the legal news website BarandBench.com, Kundra's advocate, Niranjan Mundargi, told the court that the crime branch of the Mumbai police had also submitted a supplementary charge sheet which arraigns Kundra, along with four others, as accused in the case.
He pointed out that the primary charge sheet submitted earlier did not make out an offence of cheating against Kundra. The counsel also added that the supplementary charge sheet does not say if Kundra interacted with the alleged victims of the porn film racket or had approached them with the intent of filming obscene videos.
The public prosecutor opposed the grant of bail on the grounds that the submission of a charge sheet does not mean bail can be granted.
The case was heard by chief metropolitan magistrate SB Bhajipale who granted bail. Kundra has been asked to submit a bond for Rs50,000.
Kundra was arrested on 19 July by the Mumbai police and produced before a metropolitan magistrate's court, which sent him to police custody till 23 July and, again, till 27 July. Kundra applied for bail unsuccessfully on 28 July and he was then sent to judicial custody.
Kundra had also approached the sessions court for bail, but with the submission of the supplementary charge sheet, he was allowed to withdraw that application and move the magistrate's court again for bail.
