Delhi high court watches Nyay: The Justice, issues notice on Sushant Singh Rajput's father plea seeking stay on release


While the bench did not pass any interim orders, it listed the matter for further consideration on 14 July.

The Delhi high court vacation bench of justice Anup Jairam Bhambhani and justice Jasmeet Singh issued notice on the plea seeking a stay on the release of the film Nyay: The Justice by Krishna Kishore Singh, the father of late Sushant Singh Rajput. The vacation bench sought a response from the film's producer and director after viewing clips from the film on Lapalap, the OTT platform where it had been released.

Singh has appealed against the 10 June judgment of the high court that denied a stay on the film's release. 

Rajput's father had moved court alleging that the film's release would violate the privacy of the late actor since it is based on his life. When the order had come before the current bench last week, it asked whether the film had already been released. 

Senior advocate Chander Lall, who represented the filmmaker, submitted to the court that the film had been released on the OTT platform and had garnered 1.2 lakh views. 

The vacation bench of justice Bhambhani and justice Singh declared interest in watching the film before issuing an order.

According to the legal website BarandBench.com, senior advocate Harish Salve, who represents the actor's father, stated that while the damage to reputation is limited owing to the obscure nature of the platform, it cannot be allowed to escalate.

The site quoted justice Bhambhani as observing, "As far as the investigation is concerned, the making of this film doesn't appear to interfere with the investigation. As far as defamation is concerned, I see there's a celebrity who operated in the public domain and so did his life story. Are you then saying this his life story is also subject to copyright?"

While the court noted that prima facie the film did not seem to appear defamatory, it may make it a question of damages and award compensation later on. 

The court, hence, issued a notice to the filmmaker, producer, and distributors of the film, and listed the matter for further consideration on 14 July.
